| 2.06 Board of
Trustees Bylaws: Powers and Duties of the President of the College |

A. Qualifications
and Appointment |
 |
1. The President of
the College shall be qualified by training, experience, and philosophy to develop and
maintain a comprehensive community college of high quality in accordance with
state laws
and regulations and with sound educational theory and practice. |
 |
2. The President
shall be appointed by the Board of Trustees, subject to the approval of the State Board of
Community Colleges, and shall hold office under the terms and conditions of a contract
approved by the Board of Trustees. |
 |
B. Powers |
 |
The President shall
have full authority and responsibility for the operations of the College under the
policies and regulations of the Board of Trustees and of the State Board of Community
Colleges within the budget approved by the Board of Trustees. |
 |
C. The President
shall have the following duties: |
 |
1. Be responsible
for all administrative and managerial aspects of the development and operation of the
College. |
 |
2. Appoint all
personnel and take final action on resignations, dismissals, and requests for leaves of
absence. |
 |
3. Submit
recommended policies to the board when requested to do so by the board or when deemed to
be in the best interest of the College to do so. |
 |
4. Take the
initiative in shaping and maintaining the educational policies and the character of the
College and recommend changes in the programs and services provided by the College. |
 |
5. Recommend to the
board curriculum programs deemed to be in the best interest of the citizens of Mecklenburg
County and the State of North Carolina which are not in conflict with state law or with
standards of the State Board of Community Colleges: |

a. Technical
curricula in the areas of industry, business, and health occupations. |
 |
b. Vocational and
trade curricula in the areas of industry, business, and health occupations. |
 |
c. College transfer
courses and programs in the arts and sciences. |
 |
6. Appoint lay
advisory committees as needed. |
 |
7. Provide the
Chairman of the Board with a list of items to be presented to the board with
recommendations. |
 |
8. Advise the
board
of financial and budgetary needs of the College and recommend the items to be included in
the current expense budget and the capital outlay budget.
The
board shall also be advised in the event of funding restrictions which
may result in the need for the President to declare fiscal exigency.
This declaration shall serve as notice and be applicable to all
CPCC contractual agreements. |

9. Receive and accept grants, private donations, gifts, bequests,
and the like for the Board of Trustees; apply them, or invest any of
them and apply the proceeds, for purposes and upon terms which the
agency or donor may prescribe and which are consistent with statutory
provisions and the regulations of the State Board of Community Colleges;
and maintain proper records of all such transactions as information for
the board. |

10. Authorize
expenditures, consistent with statutory regulations and state and local
board policies, of
funds available from board-approved budgets. |
 |
11. Authorize, upon
the approval of the Finance and Facilities Committee, change orders for
board-approved construction
projects when such change orders do not result in expenditures beyond the projected
budget. |
 |
12. Sign all
degrees, diplomas, and certificates awarded by the College and secure the signature of the
Chairman of the Board of Trustees on such documents when required. |
 |
13. Establish such
rules and procedures as may be necessary to implement the policies and regulations of the
Board of Trustees and the State Board of Community Colleges, and provide each
trustee with
copies of such rules and procedures in the form of a manual entitled CPCC Policies and
Procedures Manual. |

14. Discharge any
other functions which the board shall delegate. |
 |
In the event of the
President's serious disability, death, resignation, dismissal, or prolonged absence for
any other reasons, the Board of Trustees may designate an Acting President until a temporary or a
permanent President is appointed. |
