| 4.24 General
Leave of Absence |
|
 |
I. Regulation |
 |
A leave of absence
without pay and fringe benefits may be granted for a period not to exceed 90 days to a
full-time employee with more than one year of experience at the College. The employee must
give reasonable notice prior to the date of the desired leave and must state in writing
his/her intent to resume employment at CPCC at the end of the leave. |
 |
During the term of
the leave, the employee will not accrue department seniority or vacation or sick leave and
will not receive salary or fringe benefits. |
 |
Upon an exempt
employee's return after a general leave of absence, the College will assign the employee
to the position he/she vacated, or to a comparable position in the same department, unless
a reduction in force has been made necessary by institutional financial exigency or by a
reduction in the employee's program. If there has been a reduction in force during the
period of the employee's leave, the process defined in Section 4.08 II. B. 4. will be in
effect. |
 |
Upon a non-exempt
employee's return after a general leave of absence, the College may assign the employee to
the position that he/she vacated or may reassign the employee by transfer to any other
position for which the employee is qualified. A position may not be available if the
President has authorized a job class reduction for the employee's job class or if the
employee's position has been discontinued as the result of a program reduction or
financial exigency. |
 |
An extension of the
leave may be granted in extraordinary circumstances. |
 |
II. Procedure |
 |
A. The employee
will submit to the immediate administrator a written application for leave of absence. The
application will state the purpose for the leave and will include a statement of intent to
resume employment at CPCC. |
 |
B. The supervising
administrators will review the application and forward it and their recommendation to the
President. |
 |
C. The President
will review the application and the administrators recommendation and render a final
decision. |
 |
D. The President
will inform the applicant and the administrators about the decision. If the leave is
approved, the action will be entered in the records of the Board of Trustees. |
 |
E. Written
confirmation of intent to resume employment will be provided by the employee within 15
days of the anticipated return to work. |
